Terms & Conditions

Terms & Conditions Include:

1) General 
All conditions, warranties, representations and statements whether expressed or implied which are not contained herein and would otherwise be binding on File-IT Pty. Ltd, are, to the permitted by law, hereby expressly excluded.
 
2) Confirmation of Orders
Confirmation of orders must be made in writing prior to commencement of manufacture by File-IT Pty Ltd Any changes or cancellations to the written order must be advised in writing no later than 5 working days from placement of order.

After this time cancellations shall incur the full amount of the written order value.
Any costs and/or charges incurred up to the time of alteration or cancellation may be added to the customer’s account.
 
3) Delivery Dates/ Lead Times
Delivery dates and Lead times provided verbally or at time of quotation are indicative only. All lead times are subject to current workloads.
 
4) Price, Product and Condition Changes
All products, prices and conditions are subject to change without notice. Quoted prices are only valid for 1 month from date of quotation, and as such will remain firm for 31 days from the date of quotation.
 
5) Payment Terms and Retention
a) An account may only be opened on approval of a completed credit application form.
b) Unless otherwise indicated on the invoice, the terms for an approved credit account shall be full payment no later than 31 days from the date the invoice is raised. Failure to comply may result in withdrawal of credit.
c) All other transactions will be on the basis of payment with order. COD may be allowed in special circumstances.
d) If for any reason the customer is unable to take delivery of goods manufactured to a specific date, or quantity, payment is due within the terms specified at 5b) herein, from the customer’s notification of the goods availability for delivery.
e) If payment is not made in accordance with File-IT Pty. Ltd’s terms then an administration fee of 2.5% of the total retail value monthly will apply.
h) All prices and rates quoted within are inclusive of GST unless specified.
i) Delivery costs will be provided for items subject to a delivery charge.
 
6) Property
Property of goods shall remain with File-IT Pty. Ltd until payment is made in full for amounts owing by the customer.
 
7) Freight and Installation
a) Unless otherwise agreed, goods are always sold ex-works.
b) Delivery and installation of storage components and cabinetry will be to the customer’s ground floor site with reasonable heavy vehicle access, during normal business hours. Specific site placement and/or installation within a building may incur additional charges. Specific site placement above the ground floor of the customer’s premises may also incur additional charges. Specifics should be detailed by the customer with an official written order.
c) In the event that File-IT Pty. Ltd (or its contractor) incurs additional delivery and installation charges and/or waiting time of trucks, delivery and installation personnel, such additional costs and waiting time shall be added to the customer’s account. The costs and delays shall include inter alia, the following:
i) Inability to gain access or parking
ii) The site being in an unfit state due to incomplete work of other trades or if debris is not cleared.
iii) The customer’s representative not attending where that attendance was pre-arranged and necessary for the orderly completion of work.
iv) Any other reason outside File-IT Pty. Ltd’s control where the goods were unable to be installed within the allotted time frame due to difficulties or restrictions due to non performance by the customer.
v) File-IT Pty. Ltd is not liable for any delay or failure to perform due to strikes, lockout or other labour difficulties, failure due to a delay of raw materials or other goods, specified material and finishes, transportation difficulties, accident, fire, act of God or any other cause beyond File-It Pty. Ltd’s control.
 
8) Claims and Returns
(a) All claims and returns must be made within seven days of receipt of goods. The customer will be responsible for immediate examination of the goods upon arrival of the goods at the place of delivery nominated by the customer.
(b) Shortages, damages and discrepancies must be noted on all delivery advice or packing slips.
(c) All storage media, custom folders, printed folders, printed labels, in-house colour coding, clip installation carried out as per the customer’s written order accordingly will not be accepted for credit. We will also not accept returns for products where the colour ordered is slightly different from the colour pictured on the website. The colour of all products pictured on this website may vary slightly from the actual colour of the product. Not withstanding the above, approval from File-IT Pty. Ltd management MUST BE OBTAINED prior to the return of goods for any reason.
(d) At File-IT Pty. Ltd’s discretion small quantities only of products not covered at (c) above, ordered in error, may be returned for credit but will accrue a restocking fee of 20% + GST.
(e) No liquidated damages shall be allowed unless specifically agreed to in writing.

To exchange, return or organise a repair of a product please call us within seven days on 1800 002 441 and have your original receipt order handy. 

9) Storage
A storage fee of 3% per month or part thereof (in addition to any charges under 5(e) above) may be charged on the full value of any goods not accepted on the originally agreed delivery date.
 
10) Warranty
Standard warranty unless otherwise agreed by File-IT Pty. Ltd in writing covers workmanship for a maximum of 5 years for cabinetry, shelving and mobile shelving carcasses subject to wear and tear and the product being used, loaded and maintained within design constraints and according to operating instructions.

The warranty on castor bearings, wheel, runner and door mechanisms, locks, Powder coat, plating and plastic products cannot exceed that of the original manufacturer, and as such is limited to a period of 12 months.

Warranty does not cover timber/laminates.
Warranty does not cover plastic products exposed to prolonged sunlight.
Warranty is not transferable.
Warranty on storage media (cabinetry, shelving, Rolling Storage, lockers and cupboards) is void if relocated partially of full loaded.
Warranty on storage media must be moved by File-It Pty. Ltd or authorized representative/contractor to maintain warranty.
Notwithstanding the above the only conditions and warranties which are binding on File-IT Pty. Ltd in respect of the state, quality or conditions of the goods supplied by it to the customer are those imposed and required to be binding by the statute (including the Trade Practices Act 1974) and to the extent permitted thereby, the liability, if any, of File-IT Pty. Ltd arising from the breach of such conditions or warranties shall at File-IT Pty. Ltd’s option be limited to and completely discharged by:
a) In the case of goods supplied by File-IT Pty. Ltd to the customer who is a “consumer” as defined by the Trade Practices Act, 1974 by
i) Any remedy Provided by the statute; or
ii) the replacement or re-supply of goods by the Company; or
iii) the repair of the goods at File-IT Pty. Ltd’s warehouse (or where possible on-site); or
iv) The payment of the cost of the repair of goods.
b) Otherwise, by the replacement of those goods or the payment of the cost of replacing the goods , and in this event there will be no responsibility by File-IT Pty. Ltd for any special, consequential, direct or indirect loss, damage, harm or injury suffered or incurred by the customer. And otherwise all other conditions and warranties whether expressed or implied by law in respect of the state, quality or conditions of the said goods which may part from this clause be binding upon the customer are hereby expressly excluded.
 
11)Patents, Designs and Copyright
a) The Customer acknowledges that all technical information, advice, designs, in any of the accompanying literature and/or samples submitted to the customer by File-IT Pty. Ltd are confidential and proprietary information of File-IT Pty Ltd
b) The Customer will keep the information secret and confidential and will not disclose any part of it to any party without the express written consent of File-IT Pty Ltd This obligation does not apply to any part of the information which forms part of the public domain other than by reason of default on the part of the customer.
c) The Customer will not reproduce any part of the information in any form without the express authority of File-IT Pty Ltd
 
12) Applicable Law
The Agreement shall in all respects be construed to operate as an Australian contract and in conformity with the laws of the State of New South Wales and the Commonwealth of Australia and all matters and disputes regarding this Agreement shall be justiciable in the courts of this jurisdiction.
